(“KAPP GRILLS”), our mission is to provide customers with superior quality artisanal outdoor grills and related products we design, manufacture, and sell. kappgrills.com (the “Site”) was created for the benefit of our customers. Please review these Terms and Conditions. Your review of these terms constitutes your agreement to follow and be bound by them.

USE OF SITE

You must be at least eighteen (18) years old to use this Site. The content, including designs, text, graphics, information, pictures, and other material displayed on or that can be downloaded from this Site, are the property of or used with permission by KAPP GRILLS. The content of this Site is protected by copyright, trademark, and other laws and may not be used without the express written permission of KAPP GRILLS. You may not modify, reproduce, publish, display, distribute, or otherwise use any content on this Site without the express written permission of KAPP GRILLS. Creating or maintaining any link from another website to this Site without KAPP GRILLS’s express written permission is prohibited.

You are invited to post reviews, comments, suggestions, and questions on this Site as long as the contributed content is not unlawful, threatening, defamatory, obscene, profane, violating the privacy of third parties, constituting unsolicited advertising such as “junk mail,” “spam,” “chain letters,” “pyramid schemes,” and is otherwise content that we deem inappropriate. LIMITATIONS ON LIABILITY / INDEMNITY

KAPP GRILLS is not liable for any loss or damages resulting from the improper installation, care, or usage of products purchased, including but not limited to product misuse or abuse, product modification, improper product selection, and non-compliance with any applicable codes. Instructions for the proper installation and cleaning of our products can be found on our website.

Under no circumstances shall KAPP GRILLS’s liability exceed the total amount paid by you to KAPP GRILLS for the product. You agree to indemnify and hold KAPP GRILLS harmless from any violation by you of these Terms and Conditions.

CHANGES TO TERMS AND CONDITIONS

KAPP GRILLS may revise or update these Terms and Conditions at any time at its sole discretion. Changes will be effective immediately upon posting on this Site.

WARRANTY POLICY

KAPP GRILLS warrants its outdoor grills against defects in materials and workmanship under normal use for a period specified on the product page from the date of purchase. The warranty covers the cost of repairs or replacement under the conditions specified in our Warranty Policy. Damage incurred during shipping and delivery is not covered under our Warranty Policy.

SHIPPING POLICY AND DELIVERIES

Please review and confirm the details of your order, including your delivery address, to avoid additional charges. Shipping costs will be calculated and displayed before finalizing your order. KAPP GRILLS is not responsible for any custom fees or taxes applied to your orders

At the time you place your order, please review and confirm that all of the details of your order are accurate, including your delivery address. You will be responsible for any additional delivery charges or expenses resulting from inaccuracies in your order. Shipping will not commence until payment due for the full balance clears.

After you place your order, you will receive a shipment confirmation email containing either a tracking number for your purchase or a phone number for the shipping carrier. The tracking number will be active within twenty-four (24) hours. Please note that if we are experiencing a high volume of orders, there may be a short delay in the shipment process. If there will be a significant delay (more than seventy-two (72) hours) in the shipment of your order, we will contact you via email. Please note that a delay of up to thirty (30) days for custom-made doors can occur. KAPP is not responsible for any shipping delays resulting from factors out of its immediate control, such as ship or truck break-downs.

The shipping carrier will contact you directly to schedule the delivery. You will be responsible for any costs or fees, including storage fees, resulting from your failure to take delivery of the shipped product on the date and time the delivery is scheduled.

RETURN POLICY

KAPP GRILLS accepts returns under specific conditions detailed on our website. Returns are subject to a twenty percent (20%) re-stocking fee, which will be deducted from any refund.

The returned product must be sent within three (3) calendar days of the confirmed delivery date. Should there be damage please document and send images of the damages in question. Any damages occurred during shipping must be covered via “your” shipping insurance.

You must notify us in advance of any intended returns. Returned products sent without our prior knowledge will be refused and no refund given.

The returned product must be received in the same condition in which it was initially shipped.

All returned products must be insured through your shipping carrier. No refunds will be issued for products damaged during shipping. Any claims for damages incurred during shipping must be made with the carrier.

Shipping and delivery fees are not refundable, including the cost of return shipping. Products purchased with a credit card are assessed a three percent (3%) processing fee for AMEX and DISCOVER, which is also not refundable. These fees will be deducted from any refund.
